IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, INCLUDING NEGLIGENCE, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.
The content on the Site is provided for general informational and educational purposes only. It is not intended as, and should not be construed as, professional financial, legal, tax, investment, or business advice. You should not rely on any information on the Site as a substitute for professional advice tailored to your specific situation.
While we strive to provide accurate and up-to-date information, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the information, products, services, or related graphics contained on the Site for any purpose. Digital Asset Ideas participates in various affiliate marketing programs. This means that when you click on certain links on the Site and make a purchase from a third-party website, we may earn a commission at no additional cost to you. We only recommend products and services that we believe provide value to our readers.
Affiliate relationships do not influence our editorial content. Our opinions, reviews, and recommendations are our own and are based on our independent analysis and experience. Affiliate links are disclosed on the pages where they appear in accordance with Federal Trade Commission (FTC) guidelines.
You are under no obligation to click on any affiliate link or purchase any product or service advertised on the Site. Any purchase you make through an affiliate link is between you and the third-party seller, and is subject to that seller's own terms and conditions and privacy policies.
The Site may contain advertisements, sponsored content, paid insertions, or other forms of promotional material (collectively, "Advertising"). We may receive compensation for displaying Advertising on the Site. Advertising will be clearly identified as such where required by law or industry guidelines.
The inclusion of any Advertising on the Site does not constitute an endorsement, guarantee, warranty, or recommendation by Digital Asset Ideas. We do not make any representations or warranties regarding the quality, accuracy, or reliability of any advertised products or services. You are solely responsible for evaluating any products or services advertised on or linked from the Site.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Site.
These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the County of Los Angeles. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Before filing any legal action, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for a period of at least thirty (30) days. If we are unable to resolve the dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Los Angeles, California. The arbitrator's decision shall be final and binding, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
No waiver by the Company of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms and our Privacy Policy constitute the sole and entire agreement between you and Digital Asset Ideas regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
We may assign our rights and obligations under these Terms without your consent. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and of no effect.
The Site may contain links to third-party websites or services that are not owned or controlled by Digital Asset Ideas. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Digital Asset Ideas shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
We reserve the right to withdraw or amend the Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site, or the entire Site, to users.
